About keeping silence at night time
Nighttime in Kazakhstan is from 23 to 6 hours. Violation of silence at night time as well as performance of the works in residential premises and outside them with a noise not linked with urgent necessity, impeding the normal rest and calm of the individuals entails an administrative fine (according to the Code of the Republic of Kazakhstan “On Administrative Infractions”, art. 437).
Smoking is prohibited in the following public places:
- in the educational and health care institutions as well as places for rest of juveniles;
- in public catering places;
- at the cinemas, theaters, circuses, concert, viewing and exhibition halls;
- in sport arenas and other indoor facilities intended for mass recreation including nightclubs and discos;
- at the museums, libraries and lecture halls;
- in unestablished places, trains and on ships of sea and river transport;
- on board of aircraft, at buses and minibuses, trolley, taxi and urban rail transport;
- at the airport, railway, motor-vehicle and water stations;
- in state organizations;
- in premises which are working places;
- in the entrance lobby of house.
The prohibition for smoking is not applied if specially equipped places for consuming of tobacco products are defined in the places of public catering, trains, on boards of sea and river transport, at the airports, railway, and motor vehicle and water stations.
In the case of violation of the prohibition of consuming tobaccoproducts in separate public places, the administrative responsibility is provided by article 441 of the Code of the Republic of Kazakhstan “On Administrative Infractions”.
Illicit traffic in narcotic drugs
Illegal circulation of drugs, psychotropic substances, their analogues, precursors, including non-medical consumption in public places, entails criminal liability under articles 296 and 297 of the Criminal Code of the Republic of Kazakhstan.
A person who voluntarily surrendered drugs or voluntarily applied to a medical institution for the provision of medical assistance in connection with drug use for non-medical purposes, or actively facilitated the disclosure or suppression of crimes related to the trafficking in narcotic drugs is exempted from criminal responsibility under this article.
It is forbidden to drink alcoholic beverages on the streets and in other public places, except for organizations of trade and public catering, in which local executive body permits the sale of alcoholic beverages for spilling.
It is unlawful to find (appear) a person in state of intoxication in a public place in the following cases:
- appearance in a state of intoxication, offending the human dignity and public morality (when speaking foul language, untidy appearance, without clothes, lying on the ground, etc.);
- appearance in public places in a state of intoxication of minors (under the age of 18).
In case of revealing such facts, measures are taken against the offender or their legal representatives in accordance with art.440 of the Code of Administrative Offenses of the Republic of Kazakhstan.
If a person in a state of intoxication is neat, behaves adequately, with no one argues, does not swear - this is not an offense.
The statutory responsibility also entails the following actions:
- obscene language in public places;
- offensive harassment of individuals;
- desecration of living quarters;
- pollution/ of common areas, parks, squares, including the release of municipal waste in unidentified places;
- other similar actions, expressing disrespect to others, violating public order and the peace of individuals.

In case of annoying treatment in public places for the purpose of buying, selling, exchanging or purchasing things in another way, committed by a person who is not a business entity, as well as for purposes of fortune telling, begging, providing sexual services or imposing other services, you may apply to the police for their Bringing to administrative responsibility (Article 449 of the Code of Administrative Offenses of the Republic of Kazakhstan).
