According to the introduced changes to the Rules of Entry and Stay for Immigrants in Kazakhstan, foreigners staying without a visa can now remain in our country for up to 30 days.
However, within 180 days (six months), their total stay should not exceed 90 days. Citizens of the EAEU arriving in Kazakhstan can stay for a maximum of 90 days within 180 days.
In the previous version of the Rules, this issue was not regulated, and foreigners could leave Kazakhstan after the expiration of their stay and re-enter, thereby "refreshing" their stay period. These rules limiting the stay in the country will not apply to foreigners who have obtained a temporary residence permit or a visa during their stay.
The rules are brought into line with the current Article 6 of the Law "On Migration of the Population," according to which the temporary stay period in Kazakhstan for an immigrant who entered the country without a visa cannot exceed thirty calendar days from the date of crossing the State border, totaling ninety calendar days within each period of one hundred eighty calendar days.
It is worth noting that similar requirements exist in international practice. For instance, citizens of Kazakhstan can stay in Georgia for no more than 90 days within 180 days. The same rules apply to citizens of Kazakhstan in Belarus, Russia, and Ukraine.
According to the Law "On Legal Acts," the effect of a regulatory legal act does not apply to relations that arose before its entry into force. Thus, the changes made to the Rules will apply to foreigners entering our country from January 27, 2023.
In case of detecting an exceeding of the established and allowed stay period upon entry into Kazakhstan, the Border Service restricts entry into the country in accordance with Article 48 of the Law "On Migration of the Population."
